- The admissibility of
evidence is within the broad discretion of the trial court, and a ruling
will not be disturbed on appeal in the absence of an abuse of discretion.
It is the province of the trier of fact, rather than an appellate court,
to weigh the facts and to judge the credibility of the various lay and
expert witnesses. The factual determinations of the trial court, like
those of a jury, are binding on the court of appeals, and it will reverse
such findings only if they are plainly wrong or without evidence to
support them.
