<li>When considering the sufficiency of the evidence on appeal in a criminal case, an appellate court views the evidence in the light most favorable to the Commonwealth of Virginia, granting to it all reasonable inferences fairly deducible therefrom. Unless the appellate court concludes a witness's testimony must be rejected as a matter of law based on its inherent incredibility, it must defer to the credibility determinations of the fact finder, who has the opportunity of seeing and hearing the witnesses.</li>
<li>Pursuant to Va. Code Ann. § 18.2-268.2, the Commonwealth of Virginia's implied consent law, any person who operates a motor vehicle upon a highway in the Commonwealth shall be deemed thereby, as a condition of such operation, to have consented to have samples of his blood or breath taken in order to determine the alcohol or drug content of his blood, if he is arrested for violation of § 18.2-266 or § 18.2-266.1 within three hours of the alleged offense. § 18.2-268.2(A). Section 18.2-268.2(B) further provides that any person so arrested shall submit to a breath test and that if the breath test is unavailable or the person is physically unable to submit to the breath test, a blood test shall be given.</li>

The Circuit Court of Fairfax (Virginia) convicted defendant of driving under the influence of alcohol (DUI), Va. Code Ann. § 18.2-266, and maiming another person while driving under the influence of alcohol, Va. Code Ann. § 18.2-51.4. At first, the appellate court reversed his convictions, but the appellate court had since granted the Commonwealth's petition for a rehearing en banc, stayed the prior decision, and reinstated the appeal.<br />

The Virginia Court made the following holding:<br />

<li>Va. Code Ann. § 18.2-268.2, Virginia 's implied consent law, provides, in part, that (A) any person who operates a motor vehicle upon a highway in the Commonwealth of Virginia shall be deemed thereby, as a condition of such operation, to have consented to have samples of his blood, breath, or both taken for a chemical test to determine the alcohol content of his blood, if he is arrested for violation of Va. Code Ann. § 18.2-266 within three hours of the alleged offense; and (B) any person so arrested shall submit to a breath test. If the breath test is unavailable or the person is physically unable to submit to the breath test, a blood test shall be given.</li>
<li>The results of a blood or breath test provided by the implied consent law, Va. Code Ann. § 18.2-268.2, are admissible against an accused in a trial for driving under the influence of alcohol only so long as the accused has first been validly arrested. Absent a valid, timely arrest, the Commonwealth has no right to collect the blood or breath sample in the first place and, a fortiori, even less right to offer into evidence test results based on the sample. If an accused is not validly arrested prior to the taking of his blood, his consent for blood alcohol testing is not implied, and his actual consent based upon a belief, generated by the officer's recitation of the implied consent law, that he was bound to submit to a test is invalid. Thus, an untimely arrest results in exclusion of the certificate of analysis of the blood.</li>

The Fairfax Court held that Va. Code Ann. § 18.2-266 defined a single offense of driving under the influence (DUI) and its subsections merely set forth the means by which the offense could be proven. Therefore, the warrant charging defendant with driving under the influence was not invalid because it was stated in the disjunctive form. The warrant described the nature and character of the offense it charged, and put defendant on notice that he would be tried for driving under the influence in violation of Va. Code Ann. § 18.2-266.<br />

Additionally, probable cause supported the warrant as ample evidence suggested that defendant was driving under the influence of alcohol, which defendant conceded at trial.<br />

<li>In order to assert a right to compulsory process, the accused is required to make a plausible showing that the testimony sought is both material and favorable to his defense.</li>
<li>Va. Code Ann. § 18.2-266, prohibits drinking alcohol and driving under either of two separate and distinct circumstances. Va. Code Ann. § 18.2-266(i), makes it unlawful for any person to drive or operate any motor vehicle while such person has a blood alcohol concentration of 0.08 percent or more by weight by volume or 0.08 grams or more per 210 liters of breath as indicated by a chemical test. Va. Code Ann. § 18.2-266(ii), prohibits driving while such person is under the influence of alcohol.</li>
<li>Being ''under the influence of alcohol," is established when any person has consumed enough alcoholic beverages to so affect his manner, disposition, speech, muscular movement, general appearance or behavior, as to be apparent to observation. Therefore, where the Commonwealth offers no chemical test results of an accused's blood or breath, the issue becomes whether the accused is under the influence, which has to be determined from all of the evidence of his condition at the time of the alleged offense.</li>

Code Ann. § 18.2-271 requires that such conviction shall of itself operate to deprive the person so convicted of the privilege to drive or operate a motor vehicle in the Commonwealth for a period of three years from the date of the judgment or conviction. The Supreme Court of Virginia has interpreted this language as "self-executing."</li>

<li>An appellant bears the burden of producing evidence that her uncounseled misdemeanor DUI conviction resulted in the imposition of a period of incarceration, whether active or suspended. Where an appellant fails to meet that burden, the admission of her uncounseled prior conviction into evidence for proof of recidivism is not an abuse of discretion.</li>
<li>Pursuant to Va. Code Ann. § 18.2-268.2, the Commonwealth of Virginia's implied consent law, any person who operates a motor vehicle upon a highway in the Commonwealth shall be deemed thereby, as a condition of such operation, to have consented to have samples of his blood or breath taken in order to determine the alcohol or drug content of his blood, if he is arrested for violation of § 18.2-266 or § 18.2-266.1 within three hours of the alleged offense. § 18.2-268.2(A). Section 18.2-268.2(B) further provides that any person so arrested shall submit to a breath test and that if the breath test is unavailable or the person is physically unable to submit to the breath test, a blood test shall be given.</li>

chemical test to determine the alcohol content of his blood, if he is
arrested for violation of Va. Code Ann. § 18.2-266 within three hours of
the alleged offense; and (B) any person so arrested shall submit to a
breath test. If the breath test is unavailable or the person is physically
unable to submit to the breath test, a blood test shall be given.<o:p></o:p></li>
<li class="MsoNormal" style="line-height: 150%; mso-list: l0 level1 lfo1; text-align: justify;">The results of a blood
or breath test provided by the implied consent law, Va. Code Ann. §
18.2-268.2, are admissible against an accused in a trial for driving under
the influence of alcohol only so long as the accused has first been
validly arrested. Absent a valid, timely arrest, the Commonwealth has no
right to collect the blood or breath sample in the first place and, a
fortiori, even less right to offer into evidence test results based on the
sample. If an accused is not validly arrested prior to the taking of his
blood, his consent for blood alcohol testing is not implied, and his
actual consent based upon a belief, generated by the officer's recitation
of the implied consent law, that he was bound to submit to a test is
invalid. Thus, an untimely arrest results in exclusion of the certificate
of analysis of the blood.<o:p></o:p></li>

case, Va. Code Ann. § 8.01-680 requires that the appellate court review
the jury's decision to see if reasonable jurors could have made the
choices that the jury did make. The appellate court lets the decision
stand unless it concludes that no rational juror could have reached that
decision. The same standard applies when a trial judge sits as the
factfinder because the judgment of a trial court sitting without a jury is
entitled to the same weight as a jury verdict. <o:p></o:p></li>
<li class="MsoNormal" style="line-height: 150%; mso-list: l0 level1 lfo1; text-align: justify;">Though breath or blood
tests can provide evidence of intoxication, they are not necessary or
required to prove driving under the influence of alcohol or drugs. The
observable characteristics of the defendant's manner, disposition, speech,
muscular movement, general appearance or behavior may alone provide
sufficient proof of intoxication. <o:p></o:p></li>
<li class="MsoNormal" style="line-height: 150%; mso-list: l0 level1 lfo1; text-align: justify;">Flight by a defendant
after the commission of a crime is probative evidence of guilt of that
crime. A defendant's admission that he consumed several alcoholic
beverages, together with the testimony of the arresting officer regarding
the defendant's appearance and lack of coordination, is sufficient to
support a conviction for driving under the influence of alcohol.<o:p></o:p></li>

"drive" and "operate" are not synonymous.
"Driving" an automobile means putting it in motion, but
"operating" a vehicle has a broader meaning.
"Operating" not only includes the process of moving the vehicle
from one place to another but also includes starting the engine, or
manipulating the mechanical or electrical equipment of the vehicle without
actually putting the car in motion.<o:p></o:p></li>

18.2-267, any person suspected by a police officer of driving under the
influence is entitled to a preliminary breath test (PBT), and the officer
must advise the suspect of his rights. If the PBT reveals that alcohol is
present in the suspect's blood, the officer may arrest the suspect for
driving under the influence, but the result of the PBT is not admissible
at trial to prove the suspect's guilt. However, the results of the
preliminary breath test may be admitted into evidence at a pretrial
probable cause or suppression hearing. This is so because the legislature
has recognized that a preliminary breath test is reasonably trustworthy to
show that a person has consumed alcohol for purposes of determining
whether probable cause exists to make an arrest.<o:p></o:p></li>
<li class="MsoNormal" style="line-height: 150%; mso-list: l0 level1 lfo1; text-align: justify;">Probable cause exists
when the facts and circumstances within the officer's knowledge, and of
which he has reasonably trustworthy information, alone are sufficient to
warrant a person of reasonable caution to believe that an offense has been
or is being committed. By providing in Va. Code Ann § 18.2-267 that the
officer may charge an individual with driving while intoxicated on the
basis of the results of a preliminary breath test, the legislature has
recognized that this test is reasonably trustworthy to show that a person
has consumed alcohol for purposes of determining whether probable cause
exists to make an arrest.<o:p></o:p></li>

misdemeanors arising out of the same driving acts, when one of the
misdemeanors is driving under the influence of intoxicants and the other
is reckless driving. Where the evidence supports prosecution under either
of two parallel statutes, the Commonwealth has the right to elect under
which statute to proceed.<o:p></o:p></li>

the implied consent statute, Va. Code Ann. § 18.2-268.2, imposes no
obligation on an arresting officer to provide either a blood or a breath
test. In fact, the implied consent statute does not require that an
arresting officer compel submission to chemical testing. That conclusion
is particularly true where the officer arrests a driver for driving under
the influence of drugs in violation of Va. Code Ann. § 18.2-266(iii),
(iv), or (v). Nothing in the implied consent statute imposes a mandatory
duty on an arresting officer to obtain blood testing for drivers suspected
of being under the influence of drugs.<o:p></o:p></li>

under Va. Code Ann. § 18.2-36.1(A) who involuntarily causes the death of
another as the result of driving under the influence is guilty of
involuntary manslaughter and can be sentenced to up to 10 years of
imprisonment with no mandatory minimum. Under Va. Code Ann. §
18.2-36.1(B), if, in addition to the elements in § 18.2-36.1(A), the
conduct of the defendant was so gross, wanton and culpable as to show a reckless
disregard for human life, he shall be guilty of aggravated involuntary
manslaughter, a felony punishable by a term of imprisonment of not less
than 1 nor more than 20 years, 1 year of which shall be a mandatory,
minimum term of imprisonment.<o:p></o:p></li>
<li class="MsoNormal" style="line-height: 150%; mso-list: l0 level1 lfo1; text-align: justify;">Although determining
legislative intent is a factual inquiry, the analysis of whether the
legislature intended to impose multiple punishments when enacting criminal
statutes involves an examination of the offenses in the abstract, rather

court reviews the evidence in the light most favorable to the
Commonwealth. This principle requires the appellate court to discard the
evidence of the accused in conflict with that of the Commonwealth, and
regard as true all the credible evidence favorable to the Commonwealth and
all fair inferences to be drawn therefrom. Its examination of the record
is not limited to the evidence mentioned by a party in trial argument or
by the trial court in its ruling. In determining whether there is evidence
to sustain a conviction, an appellate court must consider all the evidence
admitted at trial that is contained in the record.<o:p></o:p></li>
<li class="MsoNormal" style="line-height: 150%; mso-list: l0 level1 lfo1; text-align: justify;">The "substantially
similar" standard under Va. Code Ann. § 18.2-270(E) does not require
the statutes to be exact replicas of each other. They merely must be
similar (not identical) in a substantial (not insubstantial) way. The
statutes need not substantially conform in every respect to each other.
Thus, a court need not scrutinize the foreign statute for every
idiosyncratic, insubstantial difference between it and the Virginia
statute. It looks instead to the overall purpose of the two statutes, the
framework of their principal provisions, and the elements of their
respective offenses.<o:p></o:p></li>
